Debt Relief Orders

It appears that as of April of 2009 there will be another option for people with debts they cannot service; besides trying a repayment scheme or bankruptcy: Debt Relief Orders.

Debt Relief Orders will be aimed at those that have 15K or less of debts, assets of less than £300, disposable income of less than £50 per month and really cannot afford to go bankrupt, but need relief from their debts and creditors.

One aspect will be the same as bankruptcy in that after 12 months the debts are discharged and the debtor is starting over, fresh.

Debtors qualifying and deciding to use a DRO will not be required to go though the court system and can apply for the orders online using an authorised intermediary who is a skilled debt advisor.

This will make the process easier for those that qualify and also a cheaper alternative to bankruptcy, as the fee to do a DRO will be considerably less than the current fees to file for bankruptcy.

So if you have debts of less than 15K, you cannot do an IVA, as the minimum amount of debt required is 15K or more, also if you only have a surplus of income that is less than £50 a month, while you could consider a debt management plan, it may take years, many, many years to pay the debts off. Also, for those that cannot save the fees to go bankrupt, which currently are £495, if your income exceeds 14K per annum, a DRO is a solid option.

Another option and solution for people to be relieved of their debts, and also one that will help many people who could not go bankrupt, due to the costs associated with it, and/or found the entire process daunting.

    If your sept is for 4000 pounds you will qualify for a dept relief order. However you must also satisfy
    the other criteria have assets less than 300 pounds and have 50 pounds a month or less left after paying all your
    outgoings ie rent council tax food etc including costs of any care etc. You would be advised to seek help from the citizen advice
    as they can take you through the process

    hi Tanya firstly do you own your house as this may be seen as an asset if you owe 5ooo then you may be eligible for a dro.you need to add up all your bills and household outgoings if you have less than 50 pound disposible income per month left then you would qualify.

My sister owes over £5000 to different people. She has no money left in her account after paying off all the people she needs to. But if she wasnt paying off all her debts then she would probably have about £200 left of her wages to herself. She has no assets at all, not even a car. Is she able to get a DRO?

    You can look here and inquire with one of these companies as to who maybe able to assist you in applying fro a DRO. There also is your local CAB/Citizens Advice Bureau.

Hi there, due to having to leave everything behind after fleeing domestic violence, i had to move and start fresh.
as i have two young children and recieve benifits, the only way i could but beds, sofa, fridge e.c.t was to get them on credit.
due to this, i am in such a situation i have borrowed money from my parents to meet minimum payments ontime.
I now owe my mum 1500.00
and 5 different creditors a total of 3000.
I was thinking of getting a Debt Relief Order, but the thing is my landlord is really happy with how i keep the house e.c.t and when i asked her is it okay to have prepayment meters fitted, she replied Okay thats no problem, but just please do not go bankrupt, if things get bad.
anyway so heres me confused…
is a DRO a form of Bankruptcy and will my landlord find out?
someone pleaseeeeeeeeee advise me…

hi i’m 40,000 in debt i had joined B&E at the time i was employed but still did not earn enoght to cover my debt bills.
So my payments were on a mamangement scheme with B&E .

Since i have lost my job due to redundency B&E hasnot said there would be any change , and they also get £67 a month for admin.

I am thinking of applying for a Debt relief order and by what I’ve read I meet the criteria. My only concern is I have a car (worth less than £1000) that is in my name but technically belongs to my parents. Would they take the car from me to help pay the debts?

    if your debts come under 15k including the ccj, you include that and that would then become a part of the DRO (no paying it seperately), it would also get wiped after a year. BUT you haven’t said what the ccj is for?.  There are certaing debts you cannot include in a dro and if the ccj falls under that, then it can’t be included.

I am currently in a I.V.A which is due to end in 2011. I owe 15000 +. what would be the best option for us as the finial repayment is more then we can afford. The options that I know are, pay a large amount at the end of the I.V.A, take it out for a further 5 yrs, or possible swap to a different plan I.e D.R.O. we are unsure if there are any more options that would be better suited to us. any advice?

    You can’t apply for a DRO if you have been declared bankrupt in the last 6 years; have had another DRO in the past 6 years, or if you have been in an IVA for the past 6 years. So you’re not eligable to apply, however bankruptcy could be an option for you.

Hi, i am currently filling out the paperwork for my DRO before my final meeting with Citizens Advice Bureau. I have found all the figures i owe and companies I owe to accept one which is a joint overdraft with my ex husband with Natwest. They wont give me any information over the phone as to who its been passed onto saying its in my ex’s name, it shows on my credit report with the defaulted balance in my name.     After all your bills have gone out, rent food etc, if you are left with under £50 each month you should qualify for a DRO. When calculating this you DO NOT INCLUDE your debts. If you did and still had money left over in theory you could pay those debts couldn’t you?.

Please could you advise me on what happens if you get a job whilst on a DRO? Also after the year is up what happens to your credit file and can you ever apply for credit again and what if you get a job after a year on a DRO do you then have to re-pay your creditors, because your circumstances have improved a year on? Please advise as I am eligable but am unclear on these points. Thanx

    The thing to remember is the amount you have left over after all household bills etc have gone out. It matters not weather you work or not, what matters is that you do not have more then £50 a month left over…
