Debt Relief Orders

It appears that as of April of 2009 there will be another option for people with debts they cannot service; besides trying a repayment scheme or bankruptcy: Debt Relief Orders.

Debt Relief Orders will be aimed at those that have 15K or less of debts, assets of less than £300, disposable income of less than £50 per month and really cannot afford to go bankrupt, but need relief from their debts and creditors.

One aspect will be the same as bankruptcy in that after 12 months the debts are discharged and the debtor is starting over, fresh.

Debtors qualifying and deciding to use a DRO will not be required to go though the court system and can apply for the orders online using an authorised intermediary who is a skilled debt advisor.

This will make the process easier for those that qualify and also a cheaper alternative to bankruptcy, as the fee to do a DRO will be considerably less than the current fees to file for bankruptcy.

So if you have debts of less than 15K, you cannot do an IVA, as the minimum amount of debt required is 15K or more, also if you only have a surplus of income that is less than £50 a month, while you could consider a debt management plan, it may take years, many, many years to pay the debts off. Also, for those that cannot save the fees to go bankrupt, which currently are £495, if your income exceeds 14K per annum, a DRO is a solid option.

Another option and solution for people to be relieved of their debts, and also one that will help many people who could not go bankrupt, due to the costs associated with it, and/or found the entire process daunting.

i owe nearly £4000
so does this mean I don’t qualfy
If so what help is there for me
Also I had a stroke recently and am too ill to go to court due to my mental illness what can I do please, thx

    If your sept is for 4000 pounds you will qualify for a dept relief order. However you must also satisfy
    the other criteria have assets less than 300 pounds and have 50 pounds a month or less left after paying all your
    outgoings ie rent council tax food etc including costs of any care etc. You would be advised to seek help from the citizen advice
    as they can take you through the process

Hi, i am just curious about the DRO because i am in about £5000 of debt and only make bout a £100 a week i have no assets at the moment of any price and was just wondering if i am legible for a DRO.

    hi Tanya firstly do you own your house as this may be seen as an asset if you owe 5ooo then you may be eligible for a dro.you need to add up all your bills and household outgoings if you have less than 50 pound disposible income per month left then you would qualify.

My sister owes over £5000 to different people. She has no money left in her account after paying off all the people she needs to. But if she wasnt paying off all her debts then she would probably have about £200 left of her wages to herself. She has no assets at all, not even a car. Is she able to get a DRO?

    You can look here and inquire with one of these companies as to who maybe able to assist you in applying fro a DRO. There also is your local CAB/Citizens Advice Bureau.
