	<description><![CDATA[<p>Hello,</p>
<p>I have just received a copy of my DRO application and it states that I have a preferred creditor and that I have shown a preference in the pre-submission check.</p>
<p>I made the balance transfer in an attempt to lower my payments before even knowing then I was facing insolvency.</p>
<p>I am really worried that my application may be rejected because of this.</p>
<p>Can anyone please advise me on this and also if I can add explanatory notes to my application or ask my Intermediary to do so?</p>

	<description><![CDATA[<p>Hi,&#160; I wonder if you could help please?&#160;&#160; Regarding the &#163;50 or less regulation.&#160; I have been told that you although you cannot have more than &#163;50 you must have something left each month in order to qualify for a DRO, I think &#163;1, or you cannot qualify.&#160; This seems to undermine the whole ethos of a DRO.&#160;&#160; Is it correct?</p>

Is there any way of reducing my debts to below the £15,000.00 threshold and become eligible for a DRO? (I am just over the threshold).

Can I offer payment to all of my existing Creditors at an equal rate or proportionate amount calculated by percentage of debt?

Any ideas? Please help if you can, I need to get this all behind me and move forward with my life.

<div class="postTemplate">Hi there just found this web site today!!!</div>
<div class="postTemplate"><br />Wondered if anyone else has come across this same situation.<br />I became subject to a <span class="highlight"><strong><span style="color: #ff0000;">DRO</span></strong></span> on 13th Aug this year. I included in this order an overpayment for <span class="highlight"><strong><span style="color: #ff0000;">Tax</span></strong></span> credit awarded a couple of years ago. As they have continued to make reduced payments to me i called them the other day&#160;and was infomed that because i have an on going award with them they can continue to make reduced payment to me to recover the balance, however if i was not claiming <span class="highlight"><strong><span style="color: #ff0000;">Tax</span></strong></span> <span class="highlight"><strong><span style="color: #ff0000;">Credits</span></strong></span> they would not persue me for the debt! I called to insolvency service to get clafification on this and they informed me that HM Revenue and Customs are treating these debts as they would be treat in bankruptcy and not as a <span class="highlight"><strong><span style="color: #ff0000;">DRO</span></strong></span> as the wording in the legislation is different therefore they should not continue the take the overpayment from my award. However the insolvency service say they cannot do anything about this my only option would be to persue this matter myself through the courts.</div>

<p><strong>What debt can I not include in a debt relief order?</strong></p>
<p>You may not include the following debts in a DRO:</p>
<ul>
<li>Any fine imposed for an offence</li>
<li>Certain obligations arising under an order made in family proceedings</li>
<li>Obligations arising under a maintenance assessment under the Child Support Act 1991</li>
<li>Obligations arising under a confiscation order under s1 Drug Trafficking Offences Act 1986</li>
<li>Obligation arising from a liability under a Student loan</li>
</ul>
<p>Such debts are excluded as a matter of public policy. It would not be right that, for example, an individual could evade payment of a fine by seeking the protection of insolvency proceedings. Student loans became non provable debts in bankruptcy as a result of the Higher Education Act 2004 and are excluded to protect public funds, because of the unique, non-commercial nature of these loans and their terms of repayment.</p>
